U.S. Gambling Hearings Offer Two Distinct Views Of Potential Online Gaming Legalization

Two subsequent U.S. Gambling Hearings have taken place recently, concerning the National Indian Gaming Association and online gaming. The two online gambling hearings took place in very quick succession. The Senate Committee on Indian Affairs organized the first, while the other was presented before the Subcommittee on Commerce, Trade and Manufacturing.

One hearing was pertaining to a bill that had been forwarded by Representative Barton in his effort to make online poker legal in the US. The other was connected to the legalization of online gaming, and suggested that the desires of American Indian tribes to have their say in all of the regulatory policies that concern online gaming need to be heard. While at the hearing, representatives of the Committee of Indian Affairs from two different tribes offered to completely different viewpoints on the issues.

From the Mohegan Tribe, Bozsum, the Chairman, wanted to regulate online gambling . He clearly stated that he wanted the laws to be implemented in such a way as to protect all of the rights of all tribes in the nation. They should also be allowed to be given the opportunity to compete on the same level, because he believes that all American Indian tribes have the capacity to perform as well as any other.

The chairman of the Mohegan Tribe, Bozsum, also claimed that he did not favor any state regulatory laws, because they would solely benefit smaller groups. Tribal casinos would also be required to have the right to accept any and all wagers given them by anyone that is not of Native American descent. In addition, he claimed that the online casinos that were not subject to these regulations and laws should be banned altogether.

Conversely, the Vice Chairman of the Washington-based Tulalip Tribe vehemently protested against legalizing online gambling in the US because it threatened the very existence of all land-based casinos that are run by Native Americans. The profits that were likely to be created by the traditional brick-and-mortar casinos are expected to be extraordinarily higher than the profits of the online casinos. However, he still claims that the gains from online gambling were not words partaking in because they would still adversely affect North American gambling profits.

Chairman of the National Indian Gaming Association, Ernie Stevens, clearly favored Bozsum’s take. Mr. Stevens believes that the online gambling laws must also acknowledge the fact that all of the North American Indian tribes should be given assistance when it comes to regulating online gambling. In addition, he also suggested that any revenues received by the various Native American tribes, should not be subject to federal taxes.
